Kellie assists plan sponsors with navigating complex regulatory requirements related to their health and welfare, retirement and executive compensation arrangements, including requirements under the Employee Retirement Income Security Act (ERISA), the Internal Revenue Code (the Code), the Affordable Care Act (ACA), the Consolidated Omnibus Budget Reconciliation Act (COBRA) and the Health Insurance Portability and Accountability Act (HIPAA). She also reviews and negotiates the ERISA-related provisions of proposed pension plan investments on behalf of large pension funds.
Kellie routinely prepares plan documents, reviews agreements with third-party administrators and vendors, and advises on issues related to plan administration, including correction of retirement plan errors. She also provides guidance on plan fiduciary and governance considerations, including those specific to multiple employer welfare arrangements (MEWAs) and association health plans.
In addition, Kellie assists employers with the creation of employer-assisted public charities, foundations, and programs that are designed to provide aid to employees and their families who have been negatively impacted by financial hardship, disaster, or emergency declaration, such as COVID-19. Kellie counsels employers on program design and compliance with applicable IRS rules, including Code section 139 qualified disaster payments, and prepares formal program documents and employee application materials.
