This case arose out of an explosion and fire that occurred at the water injection plant that was operated in conjunction with natural gas wells in Eastern Kentucky. An equipment malfunction resulted in spill of petroleum-by- products which were ignited resulting in severe burn injuries to the well tender. Three days later the well tender died and suit was filed by his estate and minor daughter in the Perry Circuit Court. The defendants removed the action to Federal District Court in London, KY. Following dismissal of some of the parties the case was remanded to State Court but the dismissals and remand were appealed to the Sixth Circuit.
