We represented the Southwest Ohio Regional Transit Authority in this appropriation action. After the trial court found that the Authority could not take the defendants’ property for purposes of a new transit center, the court of appeals vacated the judgment. In a subsequent appeal, the court of appeals ruled against the Authority in a fee petition brought by the defendants, even though the defendants did not prevail in the earlier appeal.  Case Citation: (1) 154 Ohio App.3d 156, 796 N.E.2d 583, 2003 Ohio 4696 (2) 2001 WL 1887723, 2001 Ohio 4010.
