Plaintiff claimed breach of contract for Trover’s termination of his family
practice residency. Trover had implemented a new policy regarding the
number of times a resident would be allowed to attempt and fail the USMLE, Step
3 examination. Chandel failed this examination a total of six times,
including three attempts after the new policy was put in place. Chandel
sought damages based upon his inability to become board-certified in family
practice. Case was tried by a jury to a defense verdict.
