We represented the Southwest Ohio Regional Transit Authority in this appropriation action. After the trial court found that the Authority could not take the defendants’ property for purposes of a new transit center, the court of appeals vacated the judgment. In a subsequent appeal, the court of appeals ruled against the Authority in a fee petition brought by the defendants, even though the defendants did not prevail in the earlier appeal.
