Whether you work in healthcare, manufacturing, construction, or other industries, you and your company have likely hired independent contractors. However, determining whether a worker is an independent contractor, rather than an employee, involves a series of ever-changing considerations and legal tests. What constitutes an independent contractor is constantly evolving and now the National Labor Relations Board (NLRB) has revised their test and indicated an eagerness to pursue these claims. Employers who get these tests wrong can face costly penalties, liabilities, and even class-action lawsuits.
