Transparency and Other New Rules for Employee Health and Welfare Plans: Important Updates to Plan Service Agreements

Employers have become responsible for many new compliance obligations in the last few years related to employee health coverage. Employers generally can’t comply with these rules without information and services provided by the plan’s third-party administrator or insurance company. The rules are complex, and we know many employers have little time to investigate. Brokers and TPAs may provide needed compliance information and assistance, but employers should double check compliance given the volume of new rules and the potential for significant penalties. Updates to service agreements are usually needed to obligate the health plan vendors to provide and post the needed information, and also because the rules prohibit certain terms that have been common in third-party service agreements.
