Representation of an industrial chemicals company in a U.S. EPA Superfund cost recovery action and a toxic tort class action lawsuit brought by a local citizen’s group in federal district court in Dayton, Ohio. Both U.S. EPA and the citizens have alleged that the client has contributed to the contamination of the local drinking water supply (a supply designated by U.S. EPA as a sole source aquifer) and intrusion of chemical vapors into nearby homes.

The Federal toxic tort class action case has been temporarily stayed. No class has yet been certified.
