Biography

Zachary represents individual clients and businesses in a variety of disputes, including complex business, IP, regulatory, and labor and employment litigation. Prior to joining Frost Brown Todd, Zachary worked with legal departments in-house and on both sides of the aisle on significant global matters. He has defended companies against IP and trade secret theft claims in federal court, as well as sophisticated claimants in international investor-state arbitration proceedings.

Legal Work Highlights

Managed all litigation in the United States, Canada, and the Cayman Islands for a global cryptocurrency exchange while in-house counsel.

Spearheaded the response to regulatory investigations into a global cryptocurrency exchange by the SEC, DOJ, CFTC, and FinCen. while in-house counsel.

Represented employees in discrimination, wage, and harassment claims against employers.

Represented one of the world’s leading developers and producers of enterprise resource planning software against allegations of trade secret theft, IP infringement, and anti-competitive practices, resulting in a successful motion for summary judgment.

Successfully defended one of the major national credit reporting agencies in several consumer claims raised under the Fair Credit Reporting Act.

Represented the former General Counsel and CFO of a billion-dollar fintech startup for claims of whistleblower retaliation, employment discrimination, and other causes of action under the False Claims Act.

Represented a Canadian mining company in an arbitration against Kazakhstan under the auspices of the World Bank’s International Centre for Settlement of Investment Disputes (ICSID), ultimately leading to a multi-million dollar award in favor of the client. –

Represented a Toronto-based mining company in an ICSID arbitration against Kazakhstan, which ultimately led to a total award in excess of U.S. $50 million.
