Biography

Alex is a pragmatic counselor and litigator who brings a wide-range of experience to the service of his clients. Alex’s practice is focused on corporate litigation, with a particular emphasis on the defense of financial institutions. He represents banks, mortgage lenders, trust departments, portfolio managers, loan servicers, private equity firms, venture capital firms, financial services insurers, and other financial services institutions in state and federal courts and arbitration forums. Alex represents the entities when, among other instances, they face compliance action or litigation under various federal and state statutes, including the West Virginia Consumer Credit and Protection Act (WVCCPA), the Fair Debt Collection Practices Act (FDCPA), the Fair Credit Reporting Act (FCRA), the Truth in Lending Act (TILA), the Real Estate Settlement Procedures Act (RESPA), the Higher Education Act (HEA), among others.

Beyond his financial services work, Alex maintains a substantial general commercial litigation practice, representing clients in real estate litigation, oil and gas litigation, coal litigation, state governmental investigations, non-compete/restrictive covenant litigation, and a wide range of business disputes.

Through his wide-range of experience as a commercial litigator, Alex has developed an expertise in class action and mass action work. He has significant experience in successfully litigating class actions in state and federal court, in addition to matters before West Virginia’s Mass Litigation Panel and the Federal Judicial Panel on Multidistrict Litigation.

Alex also has significant appellate experience and resulting successes. He regularly represents clients before the Supreme Court of Appeals of West Virginia, the Intermediate Court of Appeals of West Virginia, and the United States Court of Appeals for the Fourth Circuit.
