This case arises out of the May 20, 2006 explosion at the Kentucky Darby Mine in Harlan County, Kentucky. The explosion led to the death of five (5) coal miners and an additional serious injury. Two (2) miners were killed by the explosion, three (3) others died of carbon monoxide exposure, and another miner was seriously injured by exposure to carbon monoxide. Plaintiffs filed suit against the mine operator, the manufacturer of self-contained self rescuer breathing devices, and two (2) other coal companies. Plaintiffs seek wrongful death damages, medical expenses, pain and suffering, loss of consortium damages, emotional damages, impaired earnings, and punitive damages.
